Terms & Conditions: Purchase painting

ARTICLE 1: TRANSFER
The painting becomes the property of the buyer mentioned below by full payment. All details about the painting mentioned above are in the certificate of authenticity that is supplied together with this agreement.

ARTICLE 2: PRICE/PAYMENT
Upon delivery of the painting, the buyer pays the price agreed upon with Evita Tjon A Ten, hereafter referred to as the artist. If the buyer does not fully pay the price agreed with the artist, the painting remains the property of the artist.

ARTICLE 3: INTERIM TERMINATION
The agreement between the buyer and the artist remains applicable in case of alienation. The obligations then pass to his / her legal successors.

ARTICLE 4: COPYRIGHT
The artist retains the copyright and all other rights of intellectual or industrial property in the painting, designs, working drawings, etc. that rest on the product / painting produced by it, also after sale. Reproduction of (a part of) the painting purchased by the buyer in the form of prints, in digital form, or in any other way with the (apparent) intention to publish, distribute and / or exploit these is only permitted after explicit written permission of the artist. The buyer can reproduce the painting and / or make a photographic image for administrative and / or insurance technical purposes.

ARTICLE 5: DAMAGE,LIABILITY AND WARRANTY
For attributable shortcomings in the painting produced by the artist, the artist is only liable for replacement compensation by either a new delivery of a good painting or by a monetary compensation that does not exceed the product(ion) value. Any liability for any other form of damage, such as additional damage, consequential loss or damage due to lost profits, is excluded. In the event of a damage, this must be reported to the artist within 24 hours of delivery. Insofar as the artist imposes obligations in the previous paragraph, the artist is only required to comply with this after the other party has paid the amount owed by him / her to the artist, including what he owes to him from other agreements.

ARTICLE 6: APPLICABLE LAW AND COMPTETENT JUDGE
Dutch law applies to this agreement. Disputes arising from this agreement can only be submitted to the competent court in the District of The Hague.

Terms & Conditions: Object  Evi~lance Jewellery

ARTICLE 1: TRANSFER
The object becomes the property of the purchaser to be named after full payment. All details about the object mentioned above are in the certificate of authenticity that is delivered together with this agreement.

ARTICLE 2: PRICE/PAYMENT
Upon delivery of the object, the buyer pays the price agreed upon with Evita Tjon A Ten, hereafter referred to as the artist. If the buyer does not fully pay the Price agreed with the artist, the object remains the property of the artist.
